1. Welcome to DEBOLL<\/b><\/h4>\nOur mission<\/b>\n\nDEBOLL is a medicinal product whose Marketing Authorisation Holder is Besta Med EOOD, hereinafter referred to as Besta Med.<\/span>\n\nBesta Med was established with the mission to provide solutions and services to companies in the pharmaceutical sector. We are a dynamically developing provider engaged in parallel trade of medicinal products, distribution of medical devices, food supplements, etc. We have achieved significant and sustainable growth thanks to being a reliable partner, focused primarily on long-term cooperation with trusted partners in the sector.<\/span>\n\nOur mission is also based on the aim of achieving and maintaining transparency regarding the information we collect about you, how this information is used and shared, and your rights regarding your personal data.<\/span>\n

2. Agreement<\/b><\/h4>\nWe inform you that by accessing, registering for and\/or using the website and our services, you enter into a legally binding agreement, even when you use our services on behalf of a legal entity.<\/span>\n

  1. a) When you use the services of<\/span> deboll.eu<\/span><\/a>, you enter into a legally binding agreement with Besta Med.<\/span><\/li>\n \t
  2. b) This AGREEMENT includes the Terms and Conditions, Privacy Policy, Cookie Policy and other terms that you will see when you first use certain features of<\/span> deboll.eu<\/span><\/a>. New features may be added to the website periodically. If you do not agree with this AGREEMENT, do not access, register for, use the website or our services.<\/span><\/li>\n \t
  3. c) This AGREEMENT applies both to registered users of our services, referred to as USERS, and to unregistered users, referred to as VISITORS. The term USER applies to both categories: USERS and VISITORS.<\/span><\/li>\n \t
  4. d) In order to use the services of the website, you agree that you have reached the minimum age as defined by your local legislation. The services of the website must not be used by persons under the age of 14.<\/span><\/li>\n<\/ol>\n

    3. We take care of your personal data<\/b><\/h4>\nBy registering on the DEBOLL<\/span> website, users give their explicit consent to the collection of personal information about them, as well as to its use by Besta Med within the framework of these General Terms and Conditions and our separate Privacy Policy, which you should read carefully.<\/span>\n\nFor more details regarding our Privacy Policy, please see the following link.<\/span>\n\nBesta Med will take all lawful and reasonable measures to protect the personal information of its users.<\/span>\n\nBy using the website, you give your consent to the use of cookies in your browser. More information about cookies can be found in item 4.<\/span>\n

    5. Rules we expect you to follow as users of the website<\/b><\/h4>\n5.1 Your use of the website<\/b>\n\nThese rights and obligations apply to all users of the DEBOLL website.<\/span>\n

    1. a) In order to become users of the DEBOLL website, we will require you to complete a registration application, through which you will provide your personal data and will have to agree to these Terms and Conditions, the Privacy Policy and the Cookie Policy. Additional information may be required if you register as a legal entity.<\/span><\/li>\n \t
    2. b) You must not create another person\u2019s profile or use such a profile without permission.<\/span><\/li>\n \t
    3. c) If Besta Med deactivates your profile, you must not create another one without our permission.<\/span><\/li>\n \t
    4. d) You must not share your password or perform other actions that may endanger the security of your profile.<\/span><\/li>\n \t
    5. e) You must not transfer your profile, including the Page, to anyone else without obtaining our prior written permission.<\/span><\/li>\n \t
    6. f) If you choose a name or similar identifier for your profile or page, Besta Med reserves the right to remove or reclaim it if it considers it inappropriate, for example when a trademark owner submits a complaint regarding a username that is not closely related to the user\u2019s real name.<\/span><\/li>\n \t
    7. g) You agree to use the website in a respectful manner and not to publish offensive or misleading content.<\/span><\/li>\n \t
    8. h) You are obliged to comply with all applicable professional rules of conduct when using the DEBOLL website and its services.<\/span><\/li>\n \t
    9. i) You must not send spam or other unsolicited messages to other persons.<\/span><\/li>\n \t
    10. j) You must not perform actions that are illegal, defamatory, abusive, indecent, discriminatory or objectionable.<\/span><\/li>\n \t
    11. k) You must not publish unsolicited or unauthorized advertising. You must not send junk mail, spam, chain letters\/messages, pyramid schemes or perform other similar actions not permitted by Besta Med.<\/span><\/li>\n \t
    12. l) You agree that Besta Med reserves the right to transfer its rights and obligations concerning users, partially or entirely, to a third party.<\/span><\/li>\n<\/ol>\nYou have the right to terminate this AGREEMENT at any time, subject to item 9, Termination of this Agreement.<\/span>\n\nYou are responsible and liable for any information, content and actions related to your personal data and registration.<\/span>\n\nRegistrations undergo a verification procedure by Besta Med. Besta Med cannot guarantee the identity of everyone using our services. You are responsible for damages caused if you use a registration and profile without having the right to do so.<\/span>\n\nIf you suspect that someone is attempting to compromise your personal data, you are obliged to notify Besta Med immediately.<\/span>\n\n5.2 Notices, system messages and advertising<\/b>\n\nCommunication plays a major role in the maintenance and provision of Besta Med\u2019s services.<\/span>\n\nTo control what messages you receive by email, please review your profile settings.<\/span>\n\n5.3 Messages and sharing<\/b>\n\nBesta Med\u2019s services allow messages to be sent and information to be shared through content and through a messaging system. Information and content shared by you, if public, may also be viewed by visitors to the website. Please note that some services are confidential by default and can be viewed only by those for whom they are intended.<\/span>\n\nThe DEBOLL website is not obliged to publish any information or content and may remove such information or content at its discretion, with or without notice.<\/span>\n\n5.4 Protecting the DEBOLL website and users\u2019 information<\/b>\n\nThe Besta Med team strives to keep the website safe, but cannot guarantee this. We ask you to assist, to the best of your ability, in preserving its security.<\/span>\n

      1. a) You should strive to keep your profile secure:<\/span><\/li>\n<\/ol>\n

        1. choose a secure and difficult password, minimum 6 digits, preferably a combination of digits and letters;<\/span><\/li>\n \t
        2. protect your password;<\/span><\/li>\n \t
        3. report any suspicion that someone is attempting to access or has accessed your profile;<\/span><\/li>\n \t
        4. report any suspicion that someone is attempting to compromise or has compromised the security of the DEBOLL website.<\/span><\/li>\n<\/ol>\n

          1. b) You must not collect user content or information, or otherwise access the DEBOLL website, by automated means.<\/span><\/li>\n \t
          2. c) You must not conduct illegal marketing on the DEBOLL website.<\/span><\/li>\n \t
          3. d) You must not publish information that contains software viruses or other harmful code.<\/span><\/li>\n \t
          4. e) You must not attempt to collect login information or access a profile belonging to another person.<\/span><\/li>\n \t
          5. f) You must not harass, insult or harm other users.<\/span><\/li>\n \t
          6. g) You must not use the DEBOLL website for illegal, misleading, harmful or discriminatory purposes.<\/span><\/li>\n \t
          7. h) You must not take actions that may disable, overload or interfere with the normal functioning or interface of the DEBOLL website.<\/span><\/li>\n \t
          8. i) You must not carry out activities that simulate the appearance and functionalities of the website, or activities related to pharming and mirroring techniques that allow redirection to fake and infected websites.<\/span><\/li>\n \t
          9. j) You must not:<\/span><\/li>\n<\/ol>\n

            1. claim or imply that you are a representative of the DEBOLL website;<\/span><\/li>\n \t
            2. rent, lease, lend, trade or sell access to the website or related data;<\/span><\/li>\n \t
            3. derive monetary benefit from Besta Med\u2019s services or any other function of the website without Besta Med\u2019s explicit consent.<\/span><\/li>\n<\/ol>\n

              1. k) You must not use deep links to our services without Besta Med\u2019s explicit consent for any purpose other than promoting the DEBOLL website.<\/span><\/li>\n \t
              2. l) You will not assist or encourage any violations of this AGREEMENT or our policies.<\/span><\/li>\n<\/ol>\n5.5 Protection of the rights of other users<\/b>\n\nUsers are obliged to respect and protect the rights of other users of the DEBOLL website:<\/span>\n

                1. a) You must not publish content or take any other action on the DEBOLL website that affects or violates the rights of others or otherwise violates the law.<\/span><\/li>\n \t
                2. b) You must not copy or use information, content or data of other users available on the DEBOLL website if you do not have explicit consent to do so.<\/span><\/li>\n \t
                3. c) You must not remove any notices regarding copyright, trademarks or other proprietary rights contained in the content of the DEBOLL website.<\/span><\/li>\n \t
                4. d) You must not disclose information that you do not have the right to disclose, or violate intellectual property rights or other rights of DEBOLL or other natural or legal persons without their explicit consent.<\/span><\/li>\n<\/ol>\n5.6 Intellectual property rights<\/b>\n\nBesta Med reserves all intellectual property rights over the website, including the logo and other trademarks, service marks, designs or registered marks, technical or intellectual know-how:<\/span>\n

                  1. a) You must not use Besta Med\u2019s copyrights or trademarks or other similar marks that may cause confusion, unless you have Besta Med\u2019s prior explicit written consent.<\/span><\/li>\n \t
                  2. b) You must not copy or use information, content or data from the DEBOLL website, unless you have Besta Med\u2019s prior explicit written consent.<\/span><\/li>\n \t
                  3. c) You must not copy, modify or create derivative versions of the DEBOLL website, its services or other related technology, unless you have Besta Med\u2019s prior explicit written consent.<\/span><\/li>\n \t
                  4. d) You must not reverse engineer, decompile, disassemble, decrypt or otherwise attempt to derive the source code of the website or other related technology, or parts thereof.<\/span><\/li>\n \t
                  5. e) You must not remove any notices regarding copyright, trademarks or other proprietary rights contained in or on the DEBOLL website or in its content.<\/span><\/li>\n<\/ol>\n

                    6. User rights<\/b><\/h4>\n6.1 Sharing content on the DEBOLL website<\/b>\n\nAs a user of the DEBOLL website, you own the content and information that you publish on it and control who sees your content through the use of your profile settings. You grant Besta Med only a non-exclusive, worldwide, transferable and sublicensable licence to use, copy, modify, distribute, publish and process information and content that you have provided through the DEBOLL website, without the need for additional consent, notice and\/or compensation to you or other persons. These rights are limited as follows:<\/span>\n

                    1. a) You may terminate this licence for specific content by requesting the deletion of the relevant content from the DEBOLL website by sending a written request to office@bestamed.com.<\/span><\/li>\n \t
                    2. b) Besta Med will not include your content in advertisements for third-party products and services, including sponsored content, without your explicit consent. Besta Med has the right to display advertisements near your content and information without compensation to you or other persons.<\/span><\/li>\n \t
                    3. c) Besta Med will ask for your consent if it intends to grant other persons the right to publish your content outside the website. Other users may access your content and information and share it on the DEBOLL website.<\/span><\/li>\n \t
                    4. d) Besta Med may edit and change the format of your content, such as by translating it, modifying the size, layout or file type, or removing metadata, but will not change the meaning of your information.<\/span><\/li>\n<\/ol>\nIn order to keep the content relevant for users of the DEBOLL website and in accordance with applicable law, you agree to the following terms:<\/span>\n

                      1. a) Besta Med may access, store and use any information you provide in accordance with these Terms and Conditions, the Privacy Policy and the Cookie Policy.<\/span><\/li>\n \t
                      2. b) Besta Med is a company providing services and solutions in the healthcare sector, and the content on it should be related to the fields of health and healthcare.<\/span><\/li>\n \t
                      3. c) The content or information provided must not violate the law or anyone\u2019s rights, including intellectual property rights or a concluded contract.<\/span><\/li>\n \t
                      4. d) Applicable law may not permit the advertising of prescription-only medicines to the general public. You agree that if you publish content or information about prescription-only medicines, it will be directed only to medical specialists. If you are not sure whether the content or information concerns prescription-only medicines, you may contact a Besta Med administrator. You may also consult them on what is considered advertising or how to target your content correctly.<\/span><\/li>\n \t
                      5. e) You declare that your information is accurate. Besta Med may be legally obliged to restrict and\/or remove certain information or content from the website.<\/span><\/li>\n \t
                      6. f) When you send suggestions or provide feedback to Besta Med regarding its services, you agree that Besta Med may use and share them, but is not obliged to do so, for any purpose without compensation to you.<\/span><\/li>\n<\/ol>\n6.2 Other content<\/b>\n\nBy using the DEBOLL website, you may encounter content or information that may be inaccurate, incomplete, delayed, misleading, illegal, offensive or harmful. In general, Besta Med does not review the content provided by its users. You agree that Besta Med is not responsible for the content and information of third parties, including users, or for any damages and lost profits resulting from their use or reliance on them.<\/span>\n\n6.3 Restrictions<\/b>\n\nBesta Med has the right to change, temporarily suspend or terminate any service. Besta Med is not obliged to store, maintain or provide a copy of any content or information that users have published, except in cases expressly provided for by law.<\/span>\n\nBesta Med reserves the right to restrict the use of the website, including the number of user contacts and the possibility of connecting with other users.<\/span>\n\nBesta Med reserves the right to restrict, temporarily suspend or close a user profile in the event of suspected violation of this AGREEMENT.<\/span>\n\nThe DEBOLL website contains healthcare-related information, but does not provide medical advice. For any health problems, you should seek advice from a certified medical professional in accordance with applicable law.<\/span>\n

                        7. Disclaimer and limitation of liability<\/b><\/h4>\nWe strive to maintain the proper functioning, virus-free status and safety of the DEBOLL website, but you use it at your own risk. We provide the DEBOLL website as is, without any express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the website will always be safe, secure and error-free, or that it will always function without interruptions, delays or problems. Besta Med is not responsible for the actions, content, information or data of third parties, and you release us, our directors, managers, employees and representatives from any claims and damages, known and unknown, arising from or in any way related to any claim you have against such third parties.<\/span>\n\nTo the extent permitted by law, and unless Besta Med has entered into a separate WRITTEN AGREEMENT that takes precedence over THIS AGREEMENT, Besta Med, and those with whom Besta Med cooperates in order to provide the services, shall not be liable to you or other persons for any indirect, incidental, special, consequential or punitive damages, or any loss of data, opportunities, reputation, profits or income related to the services, such as offensive or defamatory statements, downtime or loss, use or changes to your information and content.<\/span>\n\nApplicable law may not allow the limitation or exclusion of liability or of incidental or consequential damages, so the above limitation or exclusion may not apply to you.<\/span>\n

                        8. Changes<\/b><\/h4>\nWe may periodically amend\/update these General Terms and Conditions, the Privacy Policy and the Cookie Policy. If we make any changes, we will notify you through our services and\/or through other means, in order to give you the opportunity to review the changes before they enter into force. If you continue to use our services after the notice period has expired and the changes have entered into force, this will mean that you have agreed to the amended\/updated General Terms and Conditions, Privacy Policy and Cookie Policy.<\/span>\n\nIf you do not agree with these changes, you should stop using the website and terminate your use in accordance with item 9, Termination.<\/span>\n\nWe may periodically amend\/update these General Terms and Conditions, the Privacy Policy and the Cookie Policy.                         9. Termination<\/b><\/h4>\n9.1 Termination by the user<\/b>\n\nYou may terminate this AGREEMENT at any time simply by stopping the use of our services and\/or closing your profile by sending an email to office@bestamed.com. Upon termination, you lose the right to access or use the website as a user.<\/span>\n\n9.2 Termination by Besta Med<\/b>\n\nBesta Med may terminate this AGREEMENT by sending you an email in the following cases:<\/span>\n
                          \n \t
                        1. a) If Besta Med ceases to operate the website.<\/span><\/li>\n \t
                        2. b) If Besta Med believes that you are providing false information, or that you are below the minimum age required to use the website, or that you are registering for access to areas of the website for which you do not have the required certification.<\/span><\/li>\n \t
                        3. c) If Besta Med believes that you are violating your obligations as a user.<\/span><\/li>\n \t
                        4. d) If Besta Med believes that you are violating the rights of other persons or endangering the security of the DEBOLL website or other persons.<\/span><\/li>\n \t
                        5. e) If you violate these Terms and Conditions in any other way.<\/span><\/li>\n<\/ol>\n9.3 Even after termination of the AGREEMENT, the following remain in force:<\/b>\n
                            \n \t
                          1. a) Besta Med\u2019s rights to use and disclose feedback from users;<\/span><\/li>\n \t
                          2. b) The rights of other users to re-share the content and information published by users who have terminated their participation on the website, limited to the scope of what has already been shared and copied before termination;<\/span><\/li>\n \t
                          3. c) Items 6, 9 and 10 of this AGREEMENT;<\/span><\/li>\n \t
                          4. d) Any amounts due by either party before termination remain due after termination.<\/span><\/li>\n<\/ol>\n

                            10. Dispute resolution<\/b><\/h4>\n
                              \n \t
                            1. a) All clauses shall be governed by Bulgarian law, without regard to conflict-of-law rules.<\/span><\/li>\n \t
                            2. b) Any dispute in relation to these Terms and Conditions shall be resolved by mutual agreement and in accordance with the laws of the Republic of Bulgaria.<\/span><\/li>\n \t
